DMCA Takedown & Counter-Notice Procedure
How to report copyright infringement on Podhoc and how creators can submit a counter-notice.
How to report infringing content
Podhoc respects copyright. If you believe a podcast, comment, or embed-widget render on Podhoc infringes your work, send a notice to legal@podhoc.com with the subject line DMCA Takedown — Podhoc containing:
- Your contact information (name, email, postal address, telephone).
- Identification of the copyrighted work you claim has been infringed.
- The exact URL of the allegedly infringing material on Podhoc (
https://app.podhoc.com/discover/p/<slug>for podcasts, or the comment / embed URL). - A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner’s behalf.
- Your physical or electronic signature.
We act on legitimate, complete notices within a reasonable time. Incomplete or abusive notices may be ignored.
Counter-notice
If your content was removed and you believe the removal was a mistake or misidentification, send a counter-notice to legal@podhoc.com with the subject line DMCA Counter-Notice — Podhoc containing:
- Your contact information.
- Identification of the material removed and its URL prior to removal.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
- Consent to the jurisdiction of the courts where you reside (or, if outside the European Union, where Podhoc is headquartered) and acceptance of service of process from the counter-party.
- Your physical or electronic signature.
Repeat-infringer policy
Accounts that repeatedly receive valid DMCA notices may be suspended or permanently terminated at Podhoc’s discretion, per the Terms of Use.
Embed-widget revocation
Where infringement occurs via a third-party site embedding a Podhoc podcast, Podhoc may revoke embed access for the offending host independently of removing the source podcast. See Terms of Use §“User-Generated Content (Comments and Embeds)” for the reserved legal right.
